1. Introduction
These Terms & Conditions (“Terms”) govern your access to and use of the Global Marine Platform website at https://globalmarineplatform.com (“the Platform”), operated by [Company Name], Org. nr.: [XXXXXXXXX], [Address], Norway (“we”, “us”, “our”).
By creating an account, browsing, or making any transaction on the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
These Terms apply to all users, including but not limited to: visitors, registered members, vessel buyers and sellers, charter clients and vessel owners, equipment buyers and vendors, job seekers and employers.
2. The Platform — What We Are (and What We Are Not)
Global Marine Platform is an online marketplace and intermediary that connects maritime professionals. We provide the technology, infrastructure, and tools that allow users to:
- List and browse vessels for sale
- List and browse vessels available for charter
- List and purchase maritime equipment and spare parts
- Post and apply for maritime job positions
- Create company profiles and connect with other maritime professionals
We are a facilitator, not a party to any transaction. Global Marine Platform does not own, sell, buy, charter, lease, manage, operate, or inspect any vessel, equipment, or other product listed on the Platform. We are not a broker, dealer, agent, insurer, surveyor, or employer. We do not provide maritime advice, valuations, or legal counsel.
All transactions — whether for the sale of a vessel, a charter agreement, the purchase of equipment, or an employment arrangement — are entered into directly between the relevant users. We have no control over and accept no responsibility for the quality, safety, legality, accuracy, or availability of any listing, vessel, product, service, or job posted on the Platform.
3. Accounts and Registration
3.1 Account Creation
To access certain features, you must create an account. You agree to provide accurate, complete, and current information during registration and to keep your account details up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3.2 Account Types
- Free Member: Can browse all listings, jobs, charter opportunities, and equipment. Cannot contact sellers or apply for certain features without tokens.
- Vendor: Can list vessels for sale, equipment and parts for purchase, charter vessels, and post job openings. Vendors must be approved by Global Marine Platform before listing. Approval may be revoked at any time.
- Employer: Can post maritime job listings and review applications.
3.3 Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts to use the Platform. By registering, you confirm that you meet these requirements.
3.4 Account Suspension and Termination
We reserve the right to suspend, restrict, or permanently terminate any account at our sole discretion, without prior notice, if we reasonably believe that the user has violated these Terms, engaged in fraudulent or unlawful activity, misrepresented their identity or listings, or otherwise acted in a manner harmful to the Platform or its users.
4. Contact Tokens
4.1 What Tokens Are
Contact tokens are a digital credit used on the Platform to unlock direct contact details (email, phone) of vessel sellers and charter owners. One token grants access to one contact.
4.2 Purchasing Tokens
Tokens are purchased through the Platform via Stripe and/or PayPal. All prices are displayed in Euros (EUR) and include applicable VAT where required. Tokens are delivered to your account immediately upon successful payment.
4.3 Token Usage and Validity
Once a token is used to unlock a contact, the action is final and cannot be reversed. Unused tokens remain in your account indefinitely unless your account is terminated. Tokens are non-transferable between accounts.
4.4 No Guarantee of Response
A token grants access to a seller’s or owner’s contact details. We do not guarantee that the seller or owner will respond to your enquiry, that a transaction will result, or that the information provided by the seller or owner is accurate or current.
5. Vessel Sales
5.1 Role of the Platform
Global Marine Platform provides a venue for vessel sellers and buyers to find each other. We are not a party to any vessel sale. Any sale agreement is solely between the buyer and the seller. We do not inspect, survey, value, certify, warrant, or guarantee any vessel listed on the Platform.
5.2 Seller Responsibilities
Sellers are solely responsible for the accuracy and completeness of their listings, including but not limited to: vessel specifications, condition, year of build, photos, pricing, legal title, registration status, encumbrances, liens, and any defects or known issues. Sellers must have legal authority to sell the vessel they list.
5.3 Buyer Responsibilities
Buyers are solely responsible for conducting their own due diligence before purchasing any vessel. This includes, but is not limited to: independent marine survey, title verification, flag state registration checks, lien and encumbrance searches, sea trials, and any other inspections or verifications the buyer deems necessary. We strongly recommend that buyers engage qualified marine surveyors, maritime lawyers, and other professionals before committing to any purchase.
5.4 No Warranty
Global Marine Platform makes no representations or warranties — express, implied, or statutory — regarding any vessel listed on the Platform, including but not limited to warranties of merchantability, fitness for a particular purpose, seaworthiness, compliance with classification society rules, or accuracy of listing information.
6. Charter
6.1 Role of the Platform
The Platform allows vessel owners to list vessels available for charter and allows potential charterers to browse and enquire about availability. We are a facilitator of introductions, not a charter broker, agent, or party to any charter agreement.
6.2 Charter Agreements
All charter agreements — including terms, pricing, duration, conditions, insurance requirements, crew arrangements, delivery and redelivery, cancellation terms, and any other provisions — are negotiated and agreed upon directly between the vessel owner (or their authorised representative) and the charterer. We have no involvement in these negotiations and no liability under any charter agreement.
6.3 Vessel Owner Responsibilities
Vessel owners offering charter services are solely responsible for ensuring that their vessel is seaworthy, properly maintained, adequately insured, appropriately crewed and certified, and compliant with all applicable maritime laws, flag state regulations, port state requirements, and classification society rules. Owners are responsible for the accuracy of availability calendars and all information in their listing.
6.4 Charterer Responsibilities
Charterers are responsible for conducting their own due diligence regarding any vessel they intend to charter. This includes verifying insurance coverage, crew qualifications, safety equipment, classification status, flag state compliance, and any other matters relevant to the safe and lawful operation of the vessel. Charterers must enter into a proper written charter agreement with the vessel owner before commencing any charter.
6.5 No Liability for Charter Operations
We accept no liability for any loss, damage, injury, death, delay, cancellation, mechanical failure, environmental incident, or any other event occurring before, during, or after any charter arranged through introductions made on the Platform. This includes, but is not limited to, damage to cargo, personal injury, loss of use, consequential losses, and third-party claims.
7. Equipment and Parts
7.1 Marketplace Model
Equipment and spare parts listed on the Platform are sold by independent vendors, not by Global Marine Platform. When you purchase equipment through the Platform, you are buying directly from the vendor.
7.2 Vendor Responsibilities
Vendors are solely responsible for the accuracy of product descriptions, pricing (including taxes), stock availability, product quality, compliance with applicable safety standards and regulations, and fulfilment of orders (including shipping, packaging, and delivery).
7.3 Buyer Responsibilities
Buyers should review the vendor’s product descriptions, specifications, compatibility information, and store policies before making a purchase. If you have questions about a product, contact the vendor directly through the Platform before ordering.
7.4 Shipping, Returns, and Refunds for Equipment
Each vendor defines their own shipping methods, delivery times, return policy, and refund terms. These policies are available on the vendor’s store page. Global Marine Platform is not responsible for shipping delays, lost shipments, customs duties, import taxes, damaged goods, or any disputes related to the fulfilment of equipment orders. If you experience an issue with an order, contact the vendor first.
8. Maritime Jobs
8.1 Role of the Platform
Global Marine Platform provides a job board where employers can post maritime positions and job seekers can browse and apply. We are not an employment agency, recruiter, or employer. We do not vet, screen, or verify job seekers or employers beyond basic account approval.
8.2 Employer Responsibilities
Employers are responsible for the accuracy and legality of their job postings, compliance with applicable labour laws and maritime employment regulations (including the Maritime Labour Convention where applicable), and all aspects of the hiring process and employment relationship.
8.3 Job Seeker Responsibilities
Job seekers are responsible for verifying the legitimacy of job offers, the credentials of employers, and the terms of any employment contract before accepting a position. We strongly recommend independent verification of any employer or vessel before joining.
9. Prohibited Conduct
You agree not to:
- List vessels, equipment, or jobs that are fraudulent, misleading, illegal, or that you do not have the authority to list
- Use the Platform to facilitate any illegal activity, including but not limited to money laundering, sanctions evasion, smuggling, or trafficking
- Misrepresent your identity, qualifications, certifications, or authority
- Scrape, copy, or automatically extract data from the Platform
- Circumvent the token system or share unlocked contact details with third parties
- Harass, threaten, or abuse other users
- Upload malicious code, viruses, or any content that could harm the Platform or its users
- Post content that infringes intellectual property rights of third parties
- Create multiple accounts to abuse free features or circumvent restrictions
We reserve the right to remove any listing, suspend any account, and take any other action we deem necessary to enforce these prohibitions, without prior notice and without refund of any tokens or fees.
10. Payments and Fees
10.1 Payment Processing
All payments on the Platform are processed by third-party payment providers (currently Stripe and PayPal). By making a purchase, you agree to the payment provider’s terms of service. We do not store your full payment card details.
10.2 Platform Fees
We may charge commissions or fees on vendor sales, listing credits, or other services. Applicable fees will be clearly communicated before any transaction.
10.3 Taxes
Users are responsible for determining and paying any taxes applicable to their transactions, including VAT, sales tax, customs duties, and income tax. Vendors are responsible for setting correct tax rates on their products. Global Marine Platform does not provide tax advice.
11. Refund Policy
11.1 Contact Tokens
Used tokens are non-refundable, as the contact information is delivered immediately and cannot be “unrevealed.” Unused tokens may be refunded upon request within 14 days of purchase, in accordance with the Norwegian Right of Withdrawal Act (Angrerettloven). To request a refund, contact us at [email address] with your order details.
11.2 Equipment Purchases
Returns and refunds for equipment and parts are governed by the individual vendor’s return policy, available on their store page. Under Norwegian consumer protection law (Forbrukerkjøpsloven), consumers purchasing from professional vendors have statutory rights including a 14-day right of withdrawal for distance purchases, and warranty rights for defective products. These statutory rights cannot be limited by vendor policies.
11.3 Vendor Listing Credits
Unused listing credits may be refunded within 14 days of purchase. Used listing credits are non-refundable.
12. Intellectual Property
The Platform, including its design, logo, text, graphics, software, and other content created by Global Marine Platform, is our intellectual property and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without written permission.
By submitting content to the Platform (listings, photos, descriptions, company profiles), you grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute that content on the Platform for the purpose of operating the marketplace. You retain ownership of your content and may remove it at any time by deleting your listing or account.
13. Limitation of Liability
To the fullest extent permitted by applicable law:
- Global Marine Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory.
- We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- We accept no liability for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, any transaction between users, any vessel sale or charter, any equipment purchase, any employment arrangement, or any reliance on information provided on the Platform.
- We accept no liability for any loss, damage, injury, death, or financial loss resulting from any transaction, agreement, or interaction between users of the Platform, whether or not the introduction was made through the Platform.
- Our total aggregate liability to any user for any claim arising out of or related to the Platform shall not exceed the total amount paid by that user to Global Marine Platform in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or wilful misconduct.
14. Indemnification
You agree to indemnify, defend, and hold harmless Global Marine Platform, its owners, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Platform
- Your breach of these Terms
- Any transaction you enter into with another user
- Any content you post on the Platform
- Any violation of applicable laws or third-party rights
15. Dispute Resolution
15.1 Disputes Between Users
Disputes arising from transactions between users (vessel sales, charter agreements, equipment purchases, employment) must be resolved directly between the parties involved. We may, at our sole discretion, offer informal assistance, but we are under no obligation to mediate, arbitrate, or otherwise intervene in any dispute between users.
15.2 Disputes With the Platform
If you have a dispute with Global Marine Platform regarding the Platform itself, our services, or these Terms, please contact us first at [email address] to attempt an amicable resolution. If the dispute cannot be resolved informally, it shall be governed by Norwegian law and subject to the exclusive jurisdiction of the courts of [City], Norway.
15.3 Consumer Rights
If you are a consumer within the EEA, you may also use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr to submit a complaint.
16. Third-Party Links and Services
The Platform may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You access third-party links at your own risk.
17. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, cyberattacks, government actions, power failures, or internet outages.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
19. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify registered users by email. Your continued use of the Platform after any changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Platform and close your account.
